Terms and Conditions – Subscriptions

Terms and conditions for Membership subscriptions

Subscriptions are due on the anniversary of your joining the membership.

You will be reminded at regular intervals before payment needs to be made or in the case of automatic renewals before monies are taken

Membership can be cancelled at anytime during the year but refunds will not be made.

If the automatic membership has been taken and you did not wish to renew then we will refund you in full if notified within 10 days of the membership commencement date.

Your membership entitles you to a listing on our website, access to discounted products and our teacher library and membership to the KGH Teacher support group on Facebook. Other benefits are as outlined on your membership letter.

Your listing will be automatically removed from the website if you do not renew or if you cancel your membership. We may continue to email you with updates and newsletters unless you unsubscribe.

Your listing may be withdrawn at our discretion if we feel that you have not acted in the best interest of KG Hypnobirthing and after discussions with you. Fees will not be refunded in this case.

We do not accept any liability for any losses your business may incur should your listing be removed due to non payment of fees.

Your personal information will only be used for internal purposes and will never be sold or given to 3rd party organisations. You can unsubscribe at any time via the link on the email or by contacting us on 01264 535002


Terms and Conditions – Products

Terms & Conditions for purchasing items from the KGHypnobirthing online shop.

General: In these terms & conditions “The Company” means KG Hypnobirthing Limited, 
“The Client” means the person, firm or company purchasing Goods; 
“The Goods” means the goods or services which shall be the subject of the contract between the Company and the Client.

Orders: All orders for Goods accepted by the Company are subject to these terms & conditions.

Prices: All quoted prices are in £ Sterling. 
Orders are accepted by the Company for execution at prices ruling at the date of confirmation. 
All prices quoted by the Company are subject to alteration without notice.

Payment: Payment for all Goods ordered via the internet shall be made in full at the time of placing the order 
by credit card, debit card or PayPal account transfer, securely processed by PayPal.

Legal Costs: In cases where the Company, after written notice to the Client, 
deems legal action to be necessary in order to obtain monies due to the Company from the Client, 
the Company shall be entitled to charge the Client for time and expenses incurred by such action in addition to any court, 
solicitors or other outside expenses incurred.

Property: The property in the Goods shall remain with the Company until payment in full has been made to the Company 
by the Client for the Goods and all other sums due to the Company at the date of delivery of the Goods. 
Where full payment has not been made to the Company and the Client uses the Goods, 
the property in the Goods shall be retained by the Company in so far as such Goods are identifiable.

Faults: All faults in work carried out, or Goods supplied, by the Company will be corrected at no charge to the Client. 
The Company’s liability extends only to work carried out, or Goods supplied, by the Company.

Law: These terms & conditions and the contract between the parties shall be constructed and applied in accordance with 
the Law of England and shall be subject only to the jurisdiction of the English courts.

GDPR: Your personal information will only be used for the purpose of processing your order unless you have ticked the box to confirm your acceptance for us to contact you with promotions and services that we can offer. We will never sell or give your data to any 3rd party organisation.

Terms and conditions – Teacher Training

Participant Cancellation or postponement

The fee will be repaid promptly and in full in the very unlikely event of the teacher training course being cancelled. These are the only circumstances under which a full refund will be made.

The fee is 100% due should you need to cancel or amend the course date that you are booked into if made less than four weeks before the course start.

The fee will be 50% refundable should you need to cancel or amend the course date that you are booked into if made less than eight weeks but more than four weeks before the course start.

Any amendment made, with more than eight weeks to your course date, will incur a £50.00 administration charge.


Intellectual property

Any recording or written material whether in hard copy or electronic included as part of this course and all rights worldwide (including Intellectual Property Rights) relating thereto respectively are the sole property of Katharine Graves, KG Hypnobirthing Ltd, or others from whom such rights may be derived (whether or not protected by trademark and copyright laws) and may not be used other than for the personal use of the participant in face-to-face courses while they are a registered teacher of KG Hypnobirthing Ltd without obtaining prior written permission. The participant agrees not to record the course or any part thereof. The participant also agrees that, from time to time, Katharine Graves or KG Hypnobirthing Ltd may film or record the course for sales, marketing, promotional or quality control purposes. By attending the event, the participant consents to being filmed or recorded for the duration of the event and agrees that Katharine Graves and KG Hypnobirthing Ltd shall retain all Intellectual Property Rights arising from any resulting media.


GDPR

The participant also agrees that Katharine Graves and KG Hypnobirthing Ltd shall hold your details on file and on computer and, in accordance with the GDPR Act 2018, you have the right to view, amend or delete your individual file by giving not less than seven days’ written notice. We treat your personal data with the utmost care and keep only relevant information to process your booking or membership. We will not sell or give your information to a 3rd party.

Using Hypnobirthing techniques is not a substitute for the advice of or the presence during birth or any part of pregnancy or labour of a qualified medical practitioner, midwife or obstetrician.It does not represent in fact or otherwise an alternative to appropriate medical care or for professional medical advice in any way shape or form.

Any questions or doubts that you have about the use of Hypnobirthing by you or any third party in any part should be discussed by you with your medical caregiver and the safety of or the appropriateness of this programme to you or any third party whom you represent be confirmed with your medical care giver prior to undertaking the programme.

Katharine Graves, KG Hypnobirthing Ltd, its instructors or its representatives accept no responsibility for the inappropriate use of Hypnobirthing techniques or complications or harm to any third party resulting from the use of Hypnobirthing techniques as a substitute for medical advice.

Hypnobirthing is intended solely as an ‘aid’ to ‘help’ increase the comfort of labour and birth and is not in any way a guarantee or promise of expected, imagined or actual outcome of the labour or birth in any way shape or form.

Participation in Hypnobirthing classes in any part or in total by any person or third party is undertaken with the understanding by any persons or third party that no litigation or legal action whatsoever will be initiated or that no form of compensation or reimbursement or refund will be claimed or applied for at any time now or in the future against Katharine Graves, KG Hypnobirthing Ltd, its instructors, or its representatives under any circumstances whatsoever.


Agreement

Any booking of a Hypnobirthing Teacher Training Class  assumes full and informed compliance to and agreement with all of these terms and conditions of sale. In the event of a dispute, English law pertains.


Terms & Conditions – Parent Courses

Participant Cancellation

The fee will be repaid promptly and in full if your baby arrives before the course or in the very unlikely event of the course being cancelled. These are the only circumstances under which a refund will be made.

The fee is 100% due should you need to cancel or amend the course date that you are booked into if made less than two weeks before the course start.

The fee will be 50% refundable should you need to cancel or amend the course date that you are booked into if made less than four weeks but more than two weeks before the course start.

Any amendment made with more than four weeks to your course date will incur a £30.00 administration charge.

Terms and Conditions – Affiliate Scheme

Overview and scope

This affiliate scheme relates to the KGHypnobirthing Online Parents’ course and the downloadable audios (called the ‘KGH affiliate products’). It allows affiliates to benefit when visitors from their website click on a link and then go on to purchase a KGH affiliate product.

How does it work?

When you sign up to the programme, we will create an account for you with a unique link. You will then place this on your website, emails and social media channels. We will then track this link, so that if a user clicks on your link and purchases a KGH affiliate product, a commission will be paid to you. A commission is only added to your account if they complete the payment process.

Teacher Affiliate

To qualify for the Teacher Affiliate Scheme you need to have a current teachers membership. If this is not current you are welcome to join our standard affiliate scheme.

How to sign up to the affiliate scheme

Create an account with KGH here and complete the affiliate application form and submit it. Our team will then review the information and respond to you within 28 days.

Payment intervals and rates

The payments will be calculated at the end of every quarter ending June, September, December, March and paid within 45 days of the end date of that quarter. This is to ensure that payments from customers have been cleared and all refunds accounted for. For example, payments for the quarter ending 30 June will be paid no later than 15 August. The payments will be made via bank transfer.

Pricing

KGH will periodically offer promotions with discounts for their KGH affiliate products.  If your client uses a discount code it will reduce both our net profit and your affiliate earnings.

KGH will conduct an annual review on the affiliate pricing and reserve the right to change the affiliate % commission at this time.

Cookies / traceability

If a user has clicked from your affiliate link and then returns on another occasion to purchase a KGH affiliate product, the link should still be in their history. However, if the user clears their cookies before purchasing an affiliate product, we will not be able to track the link and the commission will not be allocated to you. If you believe that you have referred someone who has purchased a KGH affiliate product and not been allocated the commission, please contact us to discuss it.

Appropriate content

You are responsible for ensuring that your content is appropriate and in line with the KGHypnobirthing values, so that it enhances our reputation.

Termination

Either you or KGHypnobirthing can end this agreement at any time in writing with 28 days’ notice or with immediate effect if there is a breach in the terms and conditions or your website or material is deemed inappropriate or out of line with the values of KGHypnobirthing.

Google Analytics

When someone visits www.kghypnobirthing.com we use a third-party service, Google Analytics, to collect standard internet log information and details of visitor behaviour patterns.  We do this to find out information such as the number of visitors to the various parts of the website.  This information is only processed in a way which does not identify individuals.  We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website.

Affiliate scheme

We operate an affiliate scheme whereby selected partners place a link on their website. When visitors click on this link and then proceed to final payment for specific products, the partner then receives a percentage of the profit on this purchase.

Remarketing

Occasionally we use re-marketing to further share information with you.  This involves placing a cookie on your computer when you browse our website, we then use a third party to share further information about our products and services.  If you have consented to the use of our cookies you may see advertisements for our products on other websites. Your Privacy Rights

You have the following rights:

  • The right to ask for a copy of personal data that we hold about you (the right of access).
